RAND: A Stability Police Force for the United States

Establishing security is the sine qua non of stability operations, since it is a prerequisite for reconstruction and development. Security requires a mix of military and police forces to deal with a range of threats from insurgents to criminal organizations. This research examines the creation of a high-end police force, which the authors call a Stability Police Force (SPF). The study considers what size force is necessary, how responsive it needs to be, where in the government it might be located, what capabilities it should have, how it could be staffed, and its cost. This monograph also considers several options for locating this force within the U.S. government, including the U.S. Marshals Service, the U.S. Secret Service, the Bureau of International Narcotics and Law Enforcement Affairs (INL) in the Department of State, and the U.S. Army’s Military Police. The authors conclude that an SPF containing 6,000 people — created in the U.S. Marshals Service and staffed by a “hybrid option,” in which SPF members are federal police officers seconded to federal, state, and local police agencies when not deployed — would be the most effective of the options considered. The SPF would be able to deploy in 30 days. The cost for this option would be $637.3 million annually, in FY2007 dollars.

“Twenty-three thousand executives and employees of various private firms work with the FBI and the Department of Homeland Security. The group, called InfraGard, receives secret warnings of terrorist threats well in advance of public notification, and sometimes before elected officials. In return, InfraGard provides information to the government. InfraGard is a quiet quasi-governmental entity which wields an unknown, but extensive, amount of power and influence….”
“InfraGard members are “very much looped into our readiness capability,” says a DHS spokeswoman. Not only does DHS “provide speakers” and do “joint presentations” with the FBI, but “[w]e also train alongside them, and they have participated in readiness exercises.” InfraGard members are involved with the Bush administration’s “National Continuity Policy,” which mandates that DHS coordinate with “private sector owners and operators of critical infrastructure, as appropriate, in order to provide for the delivery of essential services during an emergency.” InfraGard members participate in “national emergency preparation drills,” Schneck says, sometimes by the hundreds. InfraGard members are drilling in preparation for martial law, members say…In the event of martial law being declared, Infragard members will have the ability to travel in restricted areas and to evacuate citizens. But they will have other abilities and duties as well. InfraGard members, says the business owner, will be authorized to “shoot to kill” if necessary to maintain order and “protect our portion of the infrastructure. [I]f we had to use deadly force to protect it, we couldn’t be prosecuted.… We were assured that if we were forced to kill someone to protect our infrastructure, there would be no repercussions. It gave me goose bumps. It chilled me to the bone.” Other InfraGard members deny that they have ever been told such; Schneck says InfraGard members will have no civil patrol or law enforcement responsibilities. The FBI calls such assertions “ridiculous.” But the business owner’s story has been corroborated by other InfraGard members.”

 

Un-Constitutional Actions

ACLU: 100-mile ‘Constitution-free zone’ surrounds border – Raw Story 10/22/08

The ACLU says a “Constitution-free zone” exists within 100 miles of the US border, where DHS claims the authority to stop, search and detain anyone for any reason. Nearly two-thirds of the US population lives within 100 miles of the border, according to the ACLU, and the border zone encompasses scores of major metropolitan areas and even entire states.
Customs and Border Patrol, a component of DHS, was authorized by Congress to operate within a “reasonable” distance of the border, and that distance has been set at 100 miles in regulations governing CBP, the ACLU says. The authorization has been in place for decades, but complaints about abuses of the extended border zone began to ramp up as CBP was expanded and folded into DHS after 9/11.
Also of concern, according to the group, is the border patrol’s use of massive databases and watch lists to screen travelers. Much remains unknown about how those lists are compiled and it is exceedingly difficult for a person to be removed from the list once he or she is added to it.

In a survey of 120 major cities, New York was found to be the ninth most unequal in the world and Atlanta, New Orleans, Washington, and Miami had similar inequality levels to those of Nairobi, Kenya Abidjan and Ivory Coast. Many were above an internationally recognised acceptable “alert” line used to warn governments.

Emails detail Republican National Committee voter suppression in 5 states (MParent)

EXCERPT: “Previously undisclosed documents detail how Republican operatives, with the knowledge of several White House officials, engaged in an illegal, racially-motivated effort to suppress tens of thousands of votes during the 2004 presidential campaign in a state where George W. Bush was trailing his Democratic challenger, Senator John Kerry.

The documents also contain details describing how Bush-Cheney 2004 campaign officials, and at least one individual who worked for White House political adviser Karl Rove, planned to stop minorities residing in Cuyahoga County from voting on election day.

The efforts to purge voters from registration rolls was spearheaded by Tim Griffin, a former Republican National Committee opposition researcher. Griffin recently resigned from his post as interim US attorney for Little Rock Arkansas. His predecessor, Bud Cummins, was forced out to make way for Griffin.

Another set of documents, 43 pages of emails, provided to Truthout by the PBS news program “NOW,” contains blueprints for a massive effort undertaken by RNC operatives in 2004, to challenge the eligibility of voters expected to support Democratic presidential candidate John Kerry in states such as Nevada, New Mexico, Florida and Pennsylvania.

One email, dated September 30, 2004, and sent to a dozen or so staffers on the Bush-Cheney campaign and the RNC, under the subject line “voter fraud strategy conference call,” describes how campaign staffers planned to challenge the veracity of votes in a handful of battleground states in the event of a Democratic victory.”

“The lost records violate Ohio law, which states federal election records must be kept for 22 months after Election Day, and a U.S. District Court order issued last September that the 2004 ballots be preserved while the court hears a civil rights lawsuit alleging voter suppression of African-American voters in Columbus.”

Beyond a paper trail : 38 states require a paper trail, 15 of those require audits, but none conduct tests which would detect software based attacks, programming errors or bugs (News.com)

An appeals court chastised the Department of Veterans Affairs on Thursday and ordered the agency to pay retroactive benefits to Vietnam War veterans who were exposed to Agent Orange and contracted a form of leukemia. “The Department of Veterans Affairs has contributed substantially to our sense of national shame,” the opinion from the 9th U.S. Circuit Court of Appeals read.
